About These Terms
By using the website, creating an account or placing an order, you agree to these Terms and to the policies referred to in them, including our Privacy Policy, Shipping Policy and Returns and Refunds Policy.
These Terms are written for consumers purchasing products for personal use. If you wish to buy for resale, commercial distribution or another business purpose, contact us before ordering.
Nothing in these Terms limits rights that cannot lawfully be limited under UK consumer law.
03
Eligibility
You must be at least 18 years old and legally capable of entering into a contract to place an order. A person under 18 may use the website only with the involvement and permission of a parent or legal guardian.
You must provide accurate, current and complete information when ordering or creating an account.
04
Website Access and Acceptable Use
We grant you a limited, personal, non-exclusive and revocable right to access and use the website for lawful shopping and information purposes.
You must not:
use the website for unlawful, fraudulent or abusive activity;
attempt to gain unauthorised access to accounts, servers, databases or restricted areas;
introduce malware, bots, scrapers or code that disrupts the website;
copy, harvest or commercially exploit website content without permission;
interfere with another person's use of the website;
submit false reviews, impersonate another person or misrepresent an affiliation;
use automated purchasing methods intended to defeat stock limits or fair-launch controls; or
use our products, content or branding in a way that infringes rights or damages our reputation.
We may suspend or restrict access where reasonably necessary to protect customers, systems, legal rights or the integrity of a product launch.
05
Accounts and Passwords
You may be able to create a customer account. You are responsible for keeping login details confidential and for activity carried out through your account where that activity results from your failure to protect those details.
Tell us promptly at support@innerbeast.co.uk if you believe an account has been accessed without permission.
We may close or suspend an account that is fraudulent, abusive, inactive for an extended period or used in serious breach of these Terms. We will not use this power to prevent you from exercising statutory rights.
06
Product Information
We take reasonable care to describe and display products accurately. Images are illustrative, and colours may look different depending on screen settings, lighting and manufacturing batches.
Measurements and size guides are approximate and may vary slightly between styles. Product composition, care instructions and key features will be shown on the relevant product page or garment label.
Packaging may differ from images where the product itself is not materially affected.
07
Availability and Purchase Limits
Products are subject to availability. Adding an item to a basket does not reserve it.
We may apply reasonable quantity limits, particularly for limited releases, promotional products or suspected commercial resale. We may reject or cancel orders that exceed stated limits, use automated purchasing tools or appear to involve fraud or unauthorised resale.
If an item becomes unavailable after you order, we will contact you and refund the amount paid for that item.
08
How the Order Contract Is Formed
When you place an order, you make an offer to buy the selected products under these Terms.
An automated order acknowledgement confirms that we received your order. It is not acceptance of your offer.
The contract is formed when we send a dispatch confirmation, unless we expressly state another acceptance point. A separate contract is formed for each parcel or item identified in a dispatch confirmation.
We may refuse or cancel an order before acceptance where:
the item is unavailable;
payment is not authorised;
the price or description contains an obvious error;
delivery cannot be made to the address;
purchase limits are exceeded;
fraud, misuse or unauthorised resale is reasonably suspected; or
accepting the order would breach law or regulatory requirements.
If payment has already been taken for a cancelled order, we will refund it.
09
Prices, VAT and Errors
Prices are displayed in pounds sterling and include VAT where VAT is applicable, unless clearly stated otherwise.
Delivery charges and any other unavoidable charges will be shown before you confirm payment.
We may change prices at any time, but a change will not affect an order already accepted.
Despite reasonable checks, a product may occasionally be listed at an incorrect price. If the error is obvious and could reasonably have been recognised, we may cancel the order and refund you. If the error is not obvious and the order has not yet been accepted, we may contact you to confirm whether you wish to proceed at the correct price.
10
Payment
Available payment methods are displayed at checkout and may include debit or credit cards, digital wallets and third-party payment services.
You confirm that you are authorised to use the chosen payment method. Payment providers may carry out security, identity, fraud or authorisation checks.
Your payment method may be authorised when the order is placed and charged when permitted by the checkout process. If a payment fails, the order may not be accepted.
We do not charge a separate fee merely because you use a consumer debit or credit card where such a surcharge is prohibited by law.
11
Promotions and Discount Codes
Promotions and discount codes are subject to any specific terms displayed with the offer. Unless stated otherwise:
codes are limited to one per order;
codes cannot be exchanged for cash;
codes cannot be applied after an order is placed;
codes may exclude selected items, collaborations, gift cards or delivery charges;
minimum-spend requirements are calculated after other discounts and before delivery;
promotions may have a stated closing date or limited stock; and
misuse, duplication, resale or automated distribution may result in cancellation.
Where part of a discounted order is returned, the refund will reflect the price actually paid and any promotion may be recalculated fairly.
12
Gift Cards
If gift cards are offered, their value, expiry information and any additional conditions will be displayed when purchased.
Gift cards are not normally redeemable for cash and cannot be used to purchase another gift card unless stated otherwise. Lost or stolen gift-card codes may not be replaceable after use.
Nothing in this section limits rights relating to a faulty gift-card service or any mandatory cancellation right that applies before a digital code has been supplied or used.
13
Delivery
Delivery destinations, services, charges, processing times, tracking, delays and lost-parcel procedures are explained in our Shipping Policy.
You must provide a complete and accurate delivery address. Contact us immediately if a correction is required, although changes may not be possible after fulfilment begins.
Unless another time is agreed, we will deliver without undue delay and normally within 30 days after the contract is formed.
Risk passes when the goods are delivered to you, a person identified by you or a safe place expressly nominated by you. Ownership passes when we receive payment in full.
14
Cancellation, Returns and Refunds
Our Returns and Refunds Policy explains our 30-day goodwill policy and the legal cancellation rights that usually apply to online purchases.
For most eligible goods, a UK consumer may notify us of cancellation within 14 days after delivery and then has a further 14 days to return the goods. Exceptions may apply, including to personalised products and sealed hygiene-sensitive goods after the seal is broken.
Return deductions, original delivery refunds, return costs and refund times are handled as described in that policy and in accordance with applicable law.
15
Faulty or Incorrect Goods
We are legally responsible for supplying goods that are of satisfactory quality, fit for purpose and as described.
Contact support@innerbeast.co.uk if an item is faulty, damaged or incorrect. Depending on the circumstances, you may be entitled to a refund, repair, replacement or price reduction.
A manufacturer warranty is additional to, and does not replace, your statutory rights.
16
Product Care and Use
Follow the care label and product instructions. Activewear may be damaged by unsuitable washing temperatures, fabric softener, tumble drying, ironing, rough surfaces or contact with chemicals.
We are not responsible for damage caused by normal wear and tear, misuse, accidents, alterations or failure to follow care instructions. This does not affect responsibility for a defect that existed when the product was supplied.
17
Reviews and User Content
Where you submit a review, image, video or other content, you confirm that:
it is based on a genuine experience where represented as a customer review;
it is accurate to the best of your knowledge;
you own it or have permission to submit it;
it does not infringe privacy, intellectual-property or other rights;
it is not defamatory, discriminatory, threatening, obscene or unlawful; and
it does not contain malware, misleading advertising or undisclosed paid promotion.
You keep ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display it for operating and promoting Inner Beast, subject to applicable privacy and advertising law. We may moderate or remove content that breaches these Terms, and we will not knowingly publish or commission fake consumer reviews.
18
Intellectual Property
The website and its content, including the Inner Beast name, logos, product names, designs, photography, graphics, text, video, software and layout, are owned by or licensed to us and are protected by intellectual-property laws.
You may view and print limited content for personal, non-commercial use. You may not reproduce, modify, distribute, sell, scrape or commercially exploit it without prior written permission.
No right to use our trade marks or branding is granted except as expressly permitted.
19
Third-Party Services and Links
The website may link to payment providers, delivery tracking, social networks or other third-party services. We are not responsible for third-party websites that we do not control. Their own terms and privacy policies apply.
A link does not necessarily mean that we endorse every statement, product or service on the linked website.
20
Website Availability
We aim to keep the website accurate, secure and available, but uninterrupted access cannot be guaranteed. We may suspend or change website features for maintenance, security, legal or operational reasons.
We are not responsible for a temporary inability to access the website where reasonable care has been used and the interruption is outside our control. This does not affect an accepted order or any statutory right.
21
Our Responsibility for Loss or Damage
We are responsible for foreseeable loss or damage caused by our breach of these Terms or failure to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the contract was formed.
We do not exclude or limit liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breach of mandatory consumer rights; or
any other liability that cannot lawfully be excluded.
Products are supplied for domestic and private use. If you use them for a commercial or business purpose without our written agreement, we are not liable for business losses such as loss of profit, revenue, opportunity or goodwill, to the extent permitted by law.
22
Events Outside Our Reasonable Control
We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, transport disruption, industrial action, public emergencies, cyber incidents affecting essential suppliers or failures of communications networks.
We will take reasonable steps to reduce the effect, keep you informed and perform the contract as soon as reasonably possible. Your rights relating to serious or extended delivery delay remain unaffected.
23
Privacy
We process personal data as explained in our Privacy Policy and use cookies as described in our cookie information and consent tool.
24
Changes to These Terms
We may update these Terms for legal, regulatory, security, technical or business reasons. The version applying to an order is the version available when the order is placed, unless a change is required by law and applies retrospectively.
The current version will display its last-updated date.
25
Transfer of Rights
We may transfer our rights and obligations under a contract to another organisation, for example as part of a business reorganisation or sale. We will ensure that this does not reduce your rights and will notify you where required.
You may transfer your rights only where we agree in writing or where the law permits.
26
No Third-Party Rights
A contract is between you and us. No other person has a right to enforce it under the Contracts (Rights of Third Parties) Act 1999, except where the law expressly provides otherwise.
27
Severability and Waiver
If a court finds part of these Terms unlawful or unenforceable, the remaining parts continue in effect.
If we delay enforcing a right, that does not mean we waive it. A waiver on one occasion does not create a continuing waiver.
28
Governing Law and Courts
These Terms and consumer contracts are governed by the laws of England and Wales.
If you live in England or Wales, the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may bring proceedings in the courts where you live, and you retain any mandatory protections available under the law of your home part of the United Kingdom.
